Terms & Conditions

Bug Art Limited (‘Bug Art’) gives you (‘the Customer’) access to the Bug Art website (‘Website’) and sells our greeting cards and other products (‘Products’) to you subject to the terms and conditions set out below.  By buying our Products you agree to accept these terms and conditions.

1. Privacy Policy
By purchasing from our website, you are agreeing to our Privacy Policy.

2. Purchase Agreement
Once you have purchased the Products from our Website, we shall send you an email containing the details of your order and payment.  Only when we have despatched the order and confirmed this by email, shall we have legally accepted your order and entered into a contract between us.  Should there be any Products on your order that have not been despatched, these Products do not form part of the agreement.

3. Returns & Statutory Rights
You are entitled to a 14 day cooling-off period, during which time you can return the Products to us.  Once we have received them, we shall refund the cost of the Products but not the cost of returning them.  To ensure that we do receive them, please use a method where both delivery and signature are recorded.  Should we not receive the Products, we cannot refund your money.

We shall only make a full refund if the Products are returned to us in perfect condition.  The cellophane bag inside which each card and envelope is packed must remain unopened.  If the bag has been opened the cost of repackaging will be deducted from the refund.

4. Returning Defective Products
We aim to despatch the Products in perfect condition.  Occasionally, however, the Products can arrive at their destination in a damaged or defective condition.  If this is the case with your delivery, please return the defective Products to us within seven days of receiving them.  We shall then either replace the defective Products and reimburse the postage cost of returning them, or reimburse both the cost of the defective Products and the postage cost of returning them.

6. Pricing
All prices on our consumer site are inclusive of VAT at the prevailing UK VAT rate for UK Customers
Non-UK customers may be liable to pay their countries local tax at customs.

7. Minimum and Maximum Order Value
The minimum order value is £20, excluding postage costs.
The maximum order value is £200, excluding postage costs except for orders to Europe, which have a maximum of 85 cards.

8. Availability
From time to time Products may be unavailable.  In this case, we shall contact you for a substitution by email.  If we are unable to contact you or receive no reply, we shall after another week cancel the order and confirm this by email.

We shall not split the delivery for any reason.

9. Children
We do not sell products to children or anyone under the age of 18.

10. Product Description
Images on the Website are taken from the original artwork.  The description for each range includes the processes used to enhance the image – foil, emboss etc. These finishes do not show on the Website image.  By placing the order you have accepted that this is the case.

Colour quality on computer screens varies – you may find when the product arrives that the colour differs from that on your screen.  By placing the order you have accepted that this is the case.

11. Liability for Loss
Bug Art will be responsible for any losses you suffer as a result of us breaching any of the Terms and Conditions only if the losses were reasonably foreseeable when the contract was formed between us.  We shall not be responsible for any commercial or business loss – including loss of revenue, profit, data, or goodwill, or any other indirect or consequential loss that is not reasonably foreseeable when the contract was formed between us.  Bug Art does not attempt to limit in any way any liability by law for death or personal injury caused by our negligence, breach of duty, gross negligence or wilful misconduct.

12. Amendments
We reserve the right at any time to make changes to our Website, policies, and these Terms and Conditions.  You will be subject to the Terms and Conditions published at the time you order Products from this Website, other than when further changes are required by law.  If any of these conditions is deemed void or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining conditions or the contract between us.

We shall not be held responsible for any breach of our obligations under these terms and conditions if the breach arises for any reason beyond our reasonable control.

13. Copyright
The Website content, including text, graphics, logos, button icons, images, page layouts and software, is the property of Bug Art and is protected by United Kingdom international copyright and database protection laws.

You may not extract to re-use any part of the Website without Bug Art’s express written consent.

14. International (Non-UK) customers – Import duties, localised taxes and handling charges
Shipments outside of the UK may be subject to import duties and taxes, as well as shipping and handling fees, which are levied once a shipment reaches the destination country. You the customer are considered the ‘importer on record’ and as such must comply with all laws and regulations, including import duties and tax, levied by the Country in which you are receiving the goods. Customs policies vary from country to country; please contact your local customs office for further information.

Bug Art accepts no liability for any of these extra charges.

15. Jurisdiction
These terms and conditions are governed by the laws of England and Wales and will be subject to the non-exclusive jurisdiction of the English courts.
